Islamic trade contracts have been classified in many different way by the schools of thought but they all share the same principles. According to one classification, Islamic contracts involve three pillars:
1) The two parties
The two parties must be sane, capable, mature and satisfied with the deal. They mustn't be under duress, intoxication or have their competence hindered in any other way. There must be only two parties and no third party involved. The two parties may however delegate a representative to conduct the deal on their behalf however.
2) The offer and acceptance
Contracts in Islam are verbal and must involve an offer by one party and an acceptance by the other party. The offer and acceptance must match each other, be understood and must take place immediately after one another. Moreover, when trading goods, both parties or their representatives must be present in one place at the time of the deal. (i.e. this cannot be done over the internet or phone)
3) The subject matter
The subject matter i.e. the goods or services traded must be permitted in Islam and must be real and in the case of goods, must be owned by the seller at the time of the sale (except in the case of manufacture). The subject matter of the contract cannot be any prohibited goods (e.g. alcohol, drugs, idols etc), nor a prohibited service or form of contract (e.g. interest, insurance or gambling).
One of the fundamental principles of Islamic trade is that both parties must be present and satisfied with the deal. It is for this reason that we wish to explain how we regard your purchases and payments through this website.
Your payments are deposits until you accept the goods
We consider your payments as payments on account or deposits until your goods are delivered to you. Until you meet our representative (i.e. the delivery man), we will not consider you to be under
any obligation to accept the goods.
The offer and acceptance
The offer and acceptance between you and our delivery man is the actual contract and according to Islam you have the right to change your mind until our delivery man departs. If you do change your mind at this point, simply refuse the goods and ask them to return the goods to the sender, we do not want you to feel under any pressure to accept the goods unless you are fully satisfied.
NB: we will deduct the charge for the delivery service from your deposit and refund the full value of the product to you through PayPal.
Islam also gives you a divine right to a full refund within three days of the contract. If you do decide to return our goods after accepting them. Please contact us within three days by phone or email and return the goods to us within a month and we will happily refund your money.
NB: we will not pay the postage for the return and cannot refund the service charge for delivering the goods to you in the first place.
We do not accept credit card payments. By purchasing goods or services on this website you agree not to use any credit card to make payments to Happy Books. If you purchase goods or services using a credit card, we will refund your money and will not despatch any goods to you. Find out why
We do accept debit cards such as Visa, Maestro, Solo and Electron or direct debits from your bank. These are different from credit cards and permitted in Islam.
